Labor is one of
the reasons for foreigners to stay in the territory of Ukraine. At the same time
to be employed in Ukraine a foreign national has to get an
employment permit.
In order to obtain a
permit to employ a foreigner assigned to Ukraine by a foreign economic
entity to carry out some work or deliver some services under a contract
concluded between an Ukrainian and a foreign economic entity an Ukrainian
employer shall submit a copy of such a contract plus all other documents
specified in the corresponding normative acts.
All documents issued abroad in a foreign language shall
be translated into Ukrainian and notarized according to the legislation of an
issuing state and legalized by the Ministry of Foreign Affairs, otherwise not
stipulated by international agreements of Ukraine approved by the Verkhovna Rada
(the Supreme Council) of Ukraine. An employment permit a foreign national shall be issued for any
term up to one year.
For such a permit to be prolonged documents specified by the Cabinet of
Ministers of Ukraine shall be submitted not later than a month before its expiry
date.
A work permit is
a reason for a foreigner to obtain a visa of a corresponding type and a
temporary residence card
for the period
such a permit is valid.
An extended
employment permit a foreign national (unless he or she is not
against) is a reason for an employer to address internal affairs bodies to
prolong a foreigner's stay in Ukraine and issue a new temporary residence card.
An employer shall submit dully attested documents both to an Ukrainian
consulate at a place of permanent residence of a foreigner for him or her to get
a visa of a corresponding type to enter Ukraine and international affairs bodies
for registration of his or her temporary residence in Ukraine.
For an application for a
work permit foreign nationals or its extension to be
considered an employer shall be charged at a rate four times exceeding the
official minimum wage to be forwarded to the Social Insurance Fund (an
employment center). The minimum wage is set by the Cabinet of Ministers of
Ukraine.
An employer shall inform an employment center in
writing on a date of launching or terminating work within three working days
after the date of launching or terminating such work and make sure passport of a
foreigner is registered by a corresponding body of the Interior Ministry
informing an employment center on this within five working days.
Should an employer use labor of a foreign national without
permission, the State Employment Service shall charge him or her penalty for
every case of the kind (for a person) at the rate of twenty officially set
minimum wages. The order to impose such a fine is determined by law. In case of
failure to pay (or refusal to pay) the fine voluntarily within due time, it shall be collected in the order
established by law.
