According to the law stay of foreigners in the territory of Ukraine and their
registration shall comply to the following procedure: foreigners and stateless
individuals who arrive from states with visa entry regimes can stay while their
visas are valid but not more than for 90 days; foreigners and stateless
individuals who come from states without visa entry regimes can stay for 90
days, otherwise not envisaged by international treaties of Ukraine. It implies,
if there is no visa entry regime between Ukraine and a state a foreigner comes
from, he or she is entitled to stay in the territory of Ukraine for 90 days
within 180 days. Thus, general term of stay shall not exceed 90 days, though it
can be divided into some parts totaling to 90 days.
If a foreigner is willing to stay in the territory of Ukraine for more than
the mentioned above periods, the law provides him or her with the following
opportunities:
Business visa
Foreigners from the EU (European union) countries, USA, Canada, Argentina,
Georgia, Norway, Israel, Japan, Paraguay, Republic of Korea, Switzerland, The
Holy See, Malta, Monaco, Montenegro, San Marino, Andorra, Iceland,
Liechtenstein, from the countries of the CIS (Russian Federation, Armenia,
Belarus, Kazakhstan, Kyrgyzstan, Uzbekistan, Tajikistan, Moldova,
Azerbaijan) can visit Ukraine for up to 90 days in a period of 180 days without
any visa, simply having their passports stamped at the border. If you are a
citizen of a country, not mentioned above, you will be required to obtain
Ukrainian visa. Most common types of visa are tourist, private, business,
immigration related.
Business-visas are issued to foreign citizens at Ukrainian consulates abroad on
the grounds of invitations from Ukrainian enterprises and are valid for the
period of six months or more. Business - visa stamped in a passport, a foreigner
can enter the territory of Ukraine.
Registration of foreigners at a Visa and Registration Department (OVIR)
Foreigners and stateless individuals legally staying in Ukraine may
temporarily reside in the country by having registered their passport documents
in the order prescribed by the Cabinet of Ministers of Ukraine.
The stamp of the State Border Service of Ukraine in a foreigner's passport
while crossing the Ukrainian border is considered to be initial registration
valid for the period of 90 days.
To extend the stay of aliens or stateless
individuals it is necessary to submit the following documents:
If a host side is a physical person
- application of a host side.
- application of an alien or stateless individual.
- foreigner's passport document with translation.
- passport of a host side.
- document stating the place of residence for registration of an alien
or stateless individual.
- photographs.
- receipts confirming payment of services at a visa and registration
department as well as state duties for the extension of stay.
If a host side is a legal entity
- request of a host side.
- application of an alien or stateless individual.
- foreigner's passport document with translation.
- passport document of a director of the legal entity or/and of its
representative.
- copy of the abstract from the Public Register.
- copy of the order for the appointment of responsible persons.
- document stating the place of residence for registration of an
alien or stateless individual.
- photographs.
- receipts confirming payment of services at a visa and registration
department as well as state duties for the extension of stay.
Extension of stay is performed by placing a stamp in the passport
document sealed by the body that made the decision. The stamp is placed on the
first vacant page of the passport document near by the visa or registration sign
if available.
The time of stay is extended for the whole period of the existence of grounds
specified in the application, though the general term of stay in Ukraine of an
alien or stateless individual should not exceed 180 days since the date of the
last entry.
The State Migration Service of Ukraine considers the questions on the
extension of stay for aliens and stateless individuals who:
- study at educational institutions of Ukraine
- submitted the application for immigration permit
- have the status of a foreign Ukrainian as well as their spouses and
children in case of joint entry and stay in Ukraine.
- have family relations with a citizen of Ukraine, alien or stateless
individual who has a temporary or permanent residence card.
- are sentenced in Ukraine to penalties not related to imprisonment.
Some categories of
foreigners and stateless individuals can be relieved of registration of their
passport documents on the grounds of corresponding international treaties of
Ukraine.
